1.- Ownership of the Website

In accordance with the provisions of article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (hereinafter, “LSSI“), we put to your knowledge that the web https://policlinicacomarcaldelvendrell.es (hereinafter, the “Website” or the “ Web”) is owned by the POLICLÍNICA COMARCAL DEL VENDRELL, SL (hereinafter, “PCV”), ​​whose data is: The website “https://policlinicacomarcaldelvendrell.es” has been created by POLICLÍNICA COMARCAL DEL VENDRELL, SL, for informational purposes and to allow its users interact with the Polyclinic, being the domain name, registered in favor of it.

2.‐ Use of the Website

This Legal Notice (hereinafter, “Legal Notice), establishes the conditions that regulate the use of the services of the information society that the PCV makes available to users through the Web.

In this way, the access and use of the Web suppose that the user (hereinafter, the “User“) fully accepts and undertakes to fully comply with this Legal Notice, the terms and conditions, as well as the instructions or recommendations indicated in each specific case.

Access to the Website is free, except in relation to the cost of connection through the telecommunications network provided by the access provider that the User has contracted.

The PCV reserves the right to make, at any time and without the need for prior notice, modifications and updates to the Web and its contents, configuration and presentation, including this Legal Notice, so we recommend reading it before each access and navigation through the web.

The User undertakes not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of PCV or third parties, forcing themselves to use the Website, the Services and the contents included in it in a diligent, correct and lawful manner. In particular, the User undertakes to refrain from: deleting, evading or manipulating the “copyright” and other data identifying the rights of its owners incorporated into the contents of the Web, as well as the technical protection devices, or any mechanisms of information that such content may include. Likewise, the User undertakes not to carry out any act in order to damage, disable or overload the Website, or that would prevent, in any way, its normal use and operation.

In the event that this Legal Notice is breached or the PCV reasonably suspects that it is breaching them, it reserves the right to limit, suspend or terminate your access to the Website, adopting any technical measure that is necessary for that purpose.

3.‐ User registration


Access to information and part of the content displayed on the Web does not require registration by Users.

Access to the restricted area is limited to PCV Associates. At the time that the User decides to access the restricted content, they must contact the PCV through the email address elvendrell@policlinicacomarcal.com and the username and password will be provided.

User Registration requires prior acceptance of the Data Processing Policy, Cookies Policy and the Legal Notice of the Web.

To register, it will only be necessary to provide the name, surnames, a valid email address and the corporate name of the company, as well as the type of company to which it belongs (agency, advertiser, production company, media or others).

4.- Intellectual and industrial property

To this end, through this Legal Notice, except in those cases in which it is legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the Web, its contents and/or distinctive signs of the PCV.

The reproduction of elements or contents of the Web made for profit or commercial purposes is expressly and strictly prohibited.

5.‐ Limitation of Liability

The User acknowledges and accepts that the use of the Web is carried out at all times at their risk and responsibility, for which the PCV is not responsible for the misuse or improper use that may be made of the Web. For this purpose, it will only be responsible for the damages that the User may suffer due to the use of the Web, when said damages are due to our malicious action.

In particular, the PCV will not be responsible for:

  • The content of the sites linked through the links included within the Web. In this regard, the terms set forth in section 6 of this Legal Notice will apply.
  • Damages of any kind caused to the User’s computer equipment by viruses, worms, Trojan horses or any other harmful element. The User acknowledges that the use of the Internet network implies the assumption of a risk that their computer equipment may be affected by the aforementioned elements. For this purpose, the User is responsible, in any case, for the availability of adequate tools for the detection and elimination of harmful electronic programs.
  • Damages of any kind caused to the User that are caused by failures or disconnections in the telecommunications networks that produce the suspension, cancellation or interruption of the Web service. In this regard, the User acknowledges that access to the Web requires services provided by third parties outside the control of the PCV (for example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation does not correspond to the PCV.

6.- Links

The Website includes or may include links that allow the User to access other Internet pages and portals (hereinafter, “Links”). In these cases, the PCV acts as a provider of intermediation services in accordance with article 17 of the LSSI, and will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of the illegality and you have not disabled the link with due diligence. In the event that the User considers that there is a Link with illicit or inappropriate content, please notify the PCV through elvendrell@policlinicacomarcal.com. In no case, this communication will entail the obligation to withdraw the corresponding link.

The existence of Links in no way implies that the PCV has effective or any other type of knowledge of the services and contents of these in case of illegality, nor that it necessarily maintains agreements with those responsible or owners of the Links. Neither does the existence of said Links imply recommendation, promotion, identification or conformity of the PCV with the manifestations, contents or services provided through the Links. Consequently, the PCV is not responsible for the content of the Links, nor for their conditions of use and confidentiality policies, the User being solely responsible for checking and accepting them each time they access and use them.

The User and, in general, any natural or legal person who intends to establish a link from his page or site to the Web, must obtain prior written authorization from the PCV. The establishment of said link does not imply in any case the existence of relations between the PCV and the owner or owner of the site or page on which it is established, nor the acceptance or approval by the PCV of its contents or services.

In any case, the PCV reserves the right to prohibit or disable links to the Website at any time, especially in cases of illegality of the activity or content of the page or site in which it is included.

7.- Security

The PCV makes every effort to ensure that browsing through this website is carried out in the best conditions.

It is prohibited to decompile, reverse engineer, sublicense or transmit in any way, translate or make derivative works of the computer programs necessary for the operation, access and use of this website and the services contained therein. The user of the website must refrain in any case from deleting, altering, evading or manipulating any protection devices or security systems that may be installed on it.

The PCV is not responsible for any type of damage suffered by Users due to the use of browsers or different versions of the browsers for which this website has been designed.

8.- Applicable legislation and competent Courts

The use of the Website is governed and interpreted in accordance with Spanish Law and it will be understood that, by using the Website, the User agrees that any conflict or litigation that arises between the user and the PCV will be known by the courts and tribunals of the user’s domicile.

In the event that any of the provisions contained in this Legal Notice is declared invalid, it will be withdrawn or replaced. In any case, said declaration of nullity will not affect the validity of the rest of the provisions contained in this Legal Notice.
